1. Acceptance of Terms

By accessing or using the BillsHappen website and services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our service. We reserve the right to update these Terms at any time; continued use after changes constitutes acceptance.

2. Description of Service

BillsHappen operates as a financial inquiry matching service. We connect consumers who submit financing inquiries with independent, third-party lenders in our network. BillsHappen is not a lender, does not broker loans, and does not make credit or lending decisions. We do not guarantee that any inquiry will be matched with a lender or that financing will be offered or approved.

All lending, credit, and financing decisions — including approval, denial, amount, APR, and repayment terms — are made solely by the independent lender with whom you are connected. BillsHappen has no involvement in or control over those decisions.

3. Eligibility

To use this service, you must:

• Be at least 18 years of age
• Be a legal resident of the United States
• Have a valid US bank account (required by most lenders in our network)
• Provide accurate and truthful information in your inquiry

Use of this service is void where prohibited. Not all financing products are available in all states. Availability varies by state law.

4. Financing Parameters

Our inquiry matching service facilitates connections for financing amounts ranging from $500 to $5,000. Repayment terms offered by lenders in our network range from a minimum of 61 days to a maximum of 72 months (6 years). Annual Percentage Rates (APR) vary by lender and applicant profile, up to a maximum of 35.99% APR.

Representative Example: A $2,500 financing amount over 12 months at 24% APR results in total repayments of $2,831.16 and monthly payments of $235.93. Your actual terms will be provided by the lender prior to your acceptance of any offer.

5. User Obligations

When using our service, you agree to:

• Provide accurate, current, and complete information in your inquiry form
• Not submit multiple or fraudulent inquiries
• Not use the service for any unlawful purpose
• Not attempt to circumvent, disable, or interfere with our website's security features
• Review all lender terms and conditions before accepting any financing offer

6. No Guarantee of Matching or Approval

Submitting an inquiry through our website does not guarantee that you will be matched with a lender or that any lender will offer or approve financing. The decision to present, extend, or deny financing rests entirely with the independent lender. BillsHappen makes no representations regarding the likelihood of approval.

7. Third-Party Lenders

Lenders in our network are independent third parties. BillsHappen does not control, endorse, or guarantee the products, services, or conduct of any lender. Any agreement you enter into with a lender is a direct agreement between you and that lender. You should review all lender terms, rates, fees, and disclosures carefully before accepting any offer.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. BILLSHAPPEN DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR HARMFUL COMPONENTS.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BILLSHAPPEN AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, INCLUDING RELIANCE ON ANY FINANCING OFFER OR LENDER DECISION. OUR TOTAL LIABILITY SHALL NOT EXCEED $100.

10. Indemnification

You agree to indemnify and hold harmless BillsHappen and its affiliates, officers, directors, and employees from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your use of the service, your violation of these Terms, or any false or misleading information you provide.

11. Governing Law and Dispute Resolution

These Terms shall be governed by the laws of the State of Delaware, without regard to its conflict of law provisions. Any dispute arising under these Terms shall be resolved through binding arbitration under the rules of the American Arbitration Association, except that either party may seek injunctive or other equitable relief in any court of competent jurisdiction.
